NOTICE OF APPLICATION FOR ENVIRONMENTAL AUTHORISATION IN TERMS OF THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT 107 OF 1998, WATER USE LICENCE IN TERMS OF THE NATIONAL WATER ACT 36 OF 1998, AND HERITAGE PERMIT IN TERMS OF NATIONAL HERITAGE RESOURCES ACT NO. 25 OF 1999 FOR THE PROPOSED LOUIS FOURIE PRECINCT CORRIDOR MIXED HOUSING PROJECT ON VARIOUS PROPERTIES WITHIN THE JURISDICTION OF THE MOSSEL BAY LOCAL MUNICIPALITY, WESTERN CAPE PROVINCE.
PROJECT ROLE-PLAYERS

Project Details
NCC Environmental Services (Pty) (Ltd) (“NCC”) was appointed by Mossel Bay Local Municipality (the applicant) to undertake an Environmental Impact Assessment (“EIA”) for the proposed Louis Fourie Precinct Corridor Mixed Housing Project on various properties within the jurisdiction of the Mossel Bay Local Municipality, Western Cape Province.
The Mossel Bay Local Municipality is proposing the development of the Louis Fourie Precinct Corridor mixed housing project and related infrastructure on Portion of Erf 2001 Mossel Bay, Ptn of Erf 9268 Mossel Bay, Ptn of Erf 9268 Mossel Bay, Erf 9440 Mossel Bay, Erf 12400 Mossel Bay, Erf 19274 Mossel Bay and Erf 15390 Mossel Bay within the Mossel Bay Local Municipality in the Western Cape Province.
The proposed project is primarily aimed at providing affordable housing to various income groups and will contribute to alleviating the current housing need in the area. Each housing unit/stand will be provided with electricity, potable water and sanitation. The proposed establishment of a Louis Fourie Precinct Corridor mixed housing project will entail the following developments:
- The development of approximately 7370 housing units
- The development of 100 000 GLA business including a shopping centre
- The development of social amenities
- The development of public areas and open space for recreational use as well as for educational purposes. The development is summarised below.
- Clearance of 2 ha of vegetation for the development of four reservoir each with a capacity of 5 000 KL
- Upgrading the Saunders substation to a 2 x 30 MVA Capacity and development of a new switch house.
- Development of internal roads with a total length of 14, 245 km, 8m width (18- 36 m road reserve) and 2 x 2m walkways 12m long.
- Development of external roads with a total length of 20 km with 8m width.
- Establishment of water pipes with an internal diameter of 0.55m from the reservoirs the development with a total length +/- 8700 m.
- Development of stormwater pipes with a total length of 15km and internal diameters ranging from 1,3m to 1,35m.
- Development of sewer pipes to service the areas with a total length of exceeding 1000m and internal diameter of 0.3m.
- The extent of the site for the proposed development is approximately 440 hectares.
PROJECT ACTIVITIES
The proposed project will entail the Application for Environmental Authorisation in terms of the National Environmental Management Act 107 of 1998, Water Use Licence in terms of the National Water Act 36 of 1998, and Heritage Permit in terms of National Heritage Resources Act No. 25 of 1999.
An application for Environmental Authorisation (“EA”) will be lodged with the competent authority, Department of Environmental Affairs and Development Planning. The listed activities applied for in respect of the Environmental Impact Assessment Regulations, 2017 (as amended on 7 April 2017) include:
- GN R.327: Activity 9,19,24
- GN R.325: 15
- GN R.324: Activity 2,4,12,15
A Scoping Environmental Impact Report and (“S&EIR “) process will be followed which will require the investigation, assessment and communication of potential impacts as prescribed in regulations 19 and 20 of GN. R 326 (as amended). This entails Scoping Environmental Impact Report process inclusive of an Environmental Management Programme (“EMPr “) and relevant Specialist Studies in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (“NEMA”) and in accordance with EIA Regulations, 2017 (as amended).
WATER USE LICENCE APPLICATION
An Integrated Water Use Licence Application (“IWULA”) will be conducted for water uses associated with Section 21 the National Water Act, 1998 (Act No.36 of 1998) (“NWA”).

HERITAGE PERMIT
A Notice of Intent to Develop (“NID”) application will be submitted to the Heritage Western Cape (“HWC”) under Section 34 and 38 of the National Heritage Resources Act No. 25 of 1999.

PUBLIC PARTICIPATION PROCESS
A Public Participation (“PP”) process will be undertaken to grant an opportunity for Organs of State, key stakeholders, members of the public and interested and affected parties (“I&APs”) to participate in the applications process and raise any comments, issues or objections. The documentation related to the application is available for review and download on the NCC website www.ncc-group.co.za under “Public Documents”.
Commenting timeframe
The process will have the legislated 30-day period for the EIA application and 60 -day for the WULA application.
