NOTICE OF APPLICATION FOR A WATER USE LICENSE IN TERMS OF SECTION 40 OF THE NATIONAL WATER ACT (ACT 36 OF 1998) (“NWA”) FOR THE PROPOSED DEVELOPMENT OF AMAOTI NO.3 SECONDARY SCHOOL SITUATED ON FARM NO. 842 RIET RIVIER IN WARD 53, MAWOTHI TOWNSHIP, ETHEKWINI MUNICIPALITY, KWAZULU-NATAL

Project Details

The applicant (“DoE”) is proposing to develop Amaoti No. 3 Secondary School on portion 378 of farm no. 842 Riet Rivier in ward 53, Mawothi township which is situated within the jurisdictional boundary of the eThekwini Metropolitan Municipality, KZN. The proposed development entails the development of the following infrastructure:

  • Learning Spaces which accommodate 30 x Standard Classrooms, 7 x Multipurpose Classrooms (with stores), 1 x Media Centre / Library (with stores), 1 x Computer Room (with Store), 1 x Science Classroom (with Store) and 1 x Team Teaching Room.
  • Administration and Support Spaces which accommodate 1 x Principal’s Office, 2 x Deputy Principal’s Offices, 1 x General Office, 1 x Staffroom and Kitchenette, 1 x Strong room, 1 x Stock Room, 1 x Printing Room, 2 x Sick Rooms, 1 x Entrance Hall, 5 x HOD’s Offices, 1 x Counselling Suite, 2 x General Stores, 2 x Large Stores, 1 X Guard House, 1 x Refuse Room, 1 x SNP Kitchen, 1 x Tuckshop, 1 x Food Storage, 1 x Nutrition Centre Yard, 1 x Food Garden, 1 x Undercover Dining Area and 65 x vehicle parking bays for staff and visitors.
  • Civil / service infrastructure for water, sewerage, stormwater and electricity.

The proposed infrastructure associated with the proposed development is within 500m from wetlands and a portion of the stormwater infrastructure is within the 1: 100 year flood-line. In terms of the NWA these activities constitute section 21(c) and (i) water uses within the regulated area of a watercourse which may result in the impeding and/or diverting the flow and the alteration of the bed, banks, course or characteristics of a watercourse which require authorisation. A water use license (“WUL”) application will be submitted to the competent authority, DWS.

PUBLIC PARTICIPATION PROCESS

A Public Participation (“PP”) process will be undertaken in terms of section 41(4) of the NWA to grant an opportunity for Organs of State, key stakeholders, members of the public and interested and affected parties (“I&APs”) to participate in the application process and raise any comments, issues or objections. The commenting timeframe for the 60-day PP process, excluding public holidays and the period from 15 December to 5 January 2024, is indicated below:
